This instrument is the Migration (Arrangements for Child Visa Applications) Instrument 2026.
This instrument commences on the day after it is registered.
This instrument is made under subregulation 2.07(5) of the Migration Regulations 1994.
Each instrument that is specified in a Schedule to this instrument is amended or repealed as set out in the applicable items in the Schedule concerned, and any other item in a Schedule to this instrument has effect according to its terms.
In this instrument:
class, in relation to a visa, has the meaning given by regulation 2.01 of the Migration Regulations.
Migration Regulations means the Migration Regulations 1994.
6 Form, manner and place for making an application
(1) For the purposes of subitems 1108(1), 1108A(1) and 1211(1) of Schedule 1 to the Migration Regulations, an application for a visa of a class mentioned in an item of the table in Schedule 1 to this instrument must be made using the form mentioned for the item.
(2) For the purposes of paragraphs 1108(3)(a), 1108A(3)(a) and 1211(3)(a) of Schedule 1 to the Migration Regulations, an application for a visa of a class mentioned in an item of the table in Schedule 1 to this instrument must be made in the manner and at the place mentioned for the item.
7 Specified countries and periods for Child (Migrant) (Class AH) and Child (Residence) (Class BT) visa applications
(1) For the purposes of subparagraphs 1108(3)(c)(ii) and 1108A(3)(f)(ii) of Schedule 1 to the Migration Regulations, a country mentioned in Column 1 of the table in Schedule 2 to this instrument is specified.
(2) For the purposes of subparagraphs 1108(3)(c)(iii) and 1108A(3)(f)(iii) of Schedule 1 to the Migration Regulations, a period mentioned in Column 2 of the table in Schedule 2 to this instrument, in relation to the country, is specified.
An application for a class of visa mentioned in Column 2 of the table at Schedule 1 that is received at an address specified in an instrument that was in force immediately before the commencement of this instrument is taken to:
(a) be made in accordance with this instrument; and
(b) be received on the day it was first received and stamped at that address.
9 Application of amendments made by LIN 26/100
The amendments made by Schedule 1 to the Migration Legislation Amendment (Arrangements for Child Visa Applications) Instrument 2026 apply in relation to an application for a visa made on or after the commencement of LIN 26/100.
